Resident Rights

Due to Covid 19 and The Department of Health and Human Services new regulations and procedures have been implemented in facilities.

Know your rights:

  1. The right to be respected and treated with dignity and live in a safe environment free of abuse, neglect and mistreatment
  2. The right to participate in creating their own individual care plan, and be informed on their health/medical issues and have access to their medical records and daily planning
  3. The right to privacy with visitors, phone calls, mail, emails, and during ones personal care and treatment
  4. Free from restraints physical an chemical(medications) unless Dr orders for residents safety
  5. Right to be fully informed in a language they understand, available services and charges, rules and regulations, copy of resident rights, advance changes in residents living arrangements, address and phone numbers of state ombudsman and state survey agencies a copy must be signed by resident or guardian
  6. Free to do activities of their choosing both inside and outside the nursing home
  7. Rights during transfers and discharges. Right to stay unless a discharge or is necessary for residents health, or staff and other residents well-being or residents health has improved
  8. Free from discrimination, civil rights laws, and cant be discriminated because of race, color, national origin, disability, age, gender, or religion.
  9. The right to make complaints without fear or threat of retaliation. To counselor, staff, representative, family, friend, state agency, or etc.
  10. Right to have visitors social or private
  11. Make their own independent decisions personal, choosing a physician, and manage one owns financial affairs
  12. Nursing home has the obligation to protect your health and safety
  13. The nursing home must provide residents with all needed necessities and assistance in a timely manner that safely fulfills nursing homes obligations and commitments in keeping all residents healthy and keep residents mental status, dignity and self respect a top priority

Nursing home care requirements

Under the federal regulations nursing homes must provide and uphold the following

  1. Must have sufficient nursing staff to provide services to meet and maintain top quality care concerning a residents physical, mental, and psychological well-being
  2. The nursing home must ensure and prevent that residents do not develop pressure sores, if one does develop, treatment must be given to promote healing and prevent infections
  3. The nursing home must prevent the deterioration of a residents self sufficient ability dealing with both physical and motor skills
  4. The nursing home must provide treatment and services to incontinent residents
  5. The nursing home must ensure each resident get acceptable amount of nutritional and protein level
  6. The nursing home must ensure each resident receives eye and hearing devices and services for quality of care
  7. Nursing home must conduct and update comprehensive assessments of residents functional capabilities
  8. A residents comprehensive care plan with goals and tasks to be met nursing, medical, mental, and psychological needs
  9. The residents must have access and assistance to receive proper nutrition and proper hygiene
  10. The nursing home must provide adequate supervision, assistance, devices, and equipment to prevent accidents.
